Mississippi Employment Security Law & MDES Regulations

Pursuant to Mississippi Code Annotated Sections 71-5-115 and 71-5-117, the MDES Executive Director has the authority to adopt, amend, or rescind such regulations as it deems necessary to administer and interpret the Mississippi Employment Security Law. MDES has decided to use the authority granted under the law to promulgate MDES regulations by implementing the following procedure effective immediately:

MDES will post any new or amended regulation directly to the MDES Web site at www.mdes.ms.gov. The new or amended regulation will take effect a minimum of seven (7) calendar days after it is made available to the public on the MDES Web site. However, MDES has the discretion to extend this time according to logistical purposes for any Agency requirements. In making this determination, MDES will consider the effect the new regulation or amendment will have on claimants and/or employers and the time it will take to make any programmatic changes. Moreover, MDES will mail all active claimants and registered employers a notice containing the language of the new or amended regulation and the effective date of said regulation.
